Williams Dirks Dameron Files Class Action Complaint on Behalf of Home Sellers Nationwide

Along with its co-counsel, Williams Dirks Dameron filed a class action complaint on behalf of home sellers who listed properties on a Multiple Listing Service ("MLS) using a listing agent or broker affiliated with one of the following corporate defendants: 

  • Compass, Inc.

  • eXp World Holdings, Inc.

  • Redfin Corporation

  • Weichert Realtors

  • United Real Estate

  • Howard Hanna Real Estate Services

  • Douglas Elliman, Inc.

 

Additionally, the National Association of Realtors (“NAR”) is named as a defendant.

 

The complaint alleges that NAR’s rule requiring all home sellers to make a blanket, unilateral and effectively non-negotiable offer of buyer broker compensation when listing a property on an MLS is a violation of antitrust laws. In other words, home sellers are required to pay a non-negotiable fee to the buyer’s agent when listing on an MLS. Corporate Defendants participate in this conspiracy by enforcing this rule and requiring that their franchisees, brokers and agents belong to NAR and adhere to its rules.
