In May 2017, we filed a new case against Nissan concerning its rusting floorboards. We filed the case in the United States District Court for the Western District of Missouri.

 

The case is brought on behalf of a proposed class of Nissan Altima owners (model years 2002-2006) in Missouri. The case has not been certified as a class action.

 

Nissan asked the Court to dismiss the lawsuit. We filed our opposition to Nissan’s request, and the Court is considering Nissan’s motion. We do not know when the Court will issue its order.

 

In the meantime, we are participating in discovery with Nissan, meaning that we have asked Nissan for documents and other information concerning the rusted floorboards. That process is ongoing while we wait for an order from the Court on Nissan’s motion to dismiss.
